The Purpose:

The Drivers License Reinstatement Center was started by Richard Oswalt, Attorney at law. It was started to assist Kansas Drivers who have canceled, suspended or revoked drivers licenses, obtain or regain their valid driving status. Mr. Oswalt, although licensed to practice law since 1987, he started concentrating his law practice in the area of drivers license reinstatement work in 1995. He is one of a select few Kansas Lawyers whose law practice focuses on reinstating Suspended and Revoked Kansas Drivers. A substantial percentage of Mr. Oswalt’s clients come by way of referrals from other Kansas lawyers.Typically these are lawyers whom choose not to practice in traffic law, or do not have the legal expertise or desire to work with their client in these areas. The Need:

Due the Kansas driver's license being a Privilege, and not a Constitutional Right, the Kansas courts are not required to disclose to the Kansas driver what consequences will result to their driving privileges from a traffic related conviction. Unless the Kansas driver is informed by their legal counsel about the potential for a license suspension resulting from a guilty plea or a finding of guilt, the Kansas drivers first notice that their driving privileges are being suspended or revoked will come from the State of Kansas-Driver Control's office in the form of a suspension letter. Many never receive this notice due to their address being different from what Driver Control has on file, and they continue to drive until stopped again and unsuspectingly informed of their suspended license. This, of course, usually results in a new driving while suspended charge, further complicating the problem by creating additional reinstatement fees, reinstatement requirements and, often times, a new mandatory suspension period.

This process often ultimately results in the driver receiving a letter from the State declaring them as an Habitual Driver and informing them (to their surprise) of a three year license suspension. Because the State has no hardship license program for travel to and from work, this means a full three years of no driving.

Legal Cost:

Drivers license reinstatement legal fees vary from case to case depending upon driving record and length of suspension term. These legal fees typically range from $500.00 - $5,000.00. The average legal expense for a Kansas Habitual License reinstatement is approximately $3,000.00. No guarantees about license reinstatment are ever given to the client. Half of the legal fee (non-refundable legal retainer) is required up front to begin work on the case. Referral Fees

A substantial percentage of Mr. Oswalt's clients come by way of referrals from other Kansas lawyers.Typically these are lawyers whom choose not to practice in traffic law, or do not have the legal expertise or desire to work with their client in these areas. As permitted by the Kansas Rules of Professional Conduct, Rule 1.5(g), referral fees may be paid to the referring attorney of the requirements of the above Model Rules are met. All clients referred to Mr. Oswalt for drivers license reinstatement assistance, are referred back to the referring attorney for all future legal assistance, at the end of his legal representation.

Can "Habitual Licenses" be reinstated?

Yes, in certain circumstances. Both Kansas License Suspensions and Habitual Revocations may be challenged. Although not all drivers license reinstatement cases are accepted by this office. Most DUI suspensions, for example, are not reinstateable and therefore not accepted.

However, due to the complexity and overlapping nature of the numerous suspension statutes, (one suspension causing another), the legal defense for reinstatement of the license is often found through reviewing the complete driving history of the license, and finding the facts surrounding the original reason for suspension. In addition, because the stop date and conviction date of a traffic ticket are separate entries on a driver's record, if a driver receives several tickets in the same traffic stop, and these charges are pled to at different times, this may create an improper suspension by the State, due to these convictions improperly being considered as arising from separate traffic occurrences under the Habitual driving statute.
